Simplex Financials, Inc. dba Path By Simplex (also referred to herein as “Path”) privacy policies applies to Path’s Platform, websites, applications, products, marketing, and services (“Services”) to demonstrate our commitment to our customers to protect their privacy. 

Scope and Application. This privacy policy applies to information collected through our website, social media and other online products and services that display or link to this privacy policy (“online services”), information collected through our online and offline (e.g., information you submit via the online, ticket system and email), and information obtained from third parties.

Simplex Financials, Inc. may request of collect personal and business information from online users in several ways, including marketing, social media, forms for products, services, and other instances where users are invited to provide volunteer information. Simplex Financials, Inc. does not currently respond to “Do Not Track” signals.

Through some features of the Platform, certain promotions and on various portions of the websites and applications on which a link to this Privacy Policy appears, other people may be able to submit information about you to us. For example, if you do business with them. The types of personal and/or company information that people may submit about you and/or company in the accounting software integration. 

Maintaining a Secure Environment. Simplex Financials, Inc. uses the information we collect from you and your company to prevent, detect, investigate, and report fraud or security incidents related to the use of the service and/or account. We use your information to investigate any error, unauthorized access, unauthorized transactions, or other fraud or security incident that is discovered or reported to us. 

We use the information that we collect to comply and enforce our Term of Services Agreement and with all laws and regulations applicable to the Service. We use the information that we collect to secure and protect the integrity of the network, prevent unauthorized access to the platform, help diagnose and troubleshoot potential hardware malfunctions, and otherwise secure the platform. 

Important Information about our Online Platform and Mobile App Permissions. When you use our online platform and mobile app, we may request access to certain types of data stored on your device that apps cannot access without your consent (e.g., financial, apps, calendar, and contacts data). The permission system for obtaining your consent depends on the mobile platform (iOS, Android, etc.) you are using. If you give us permission to access this platform data, we will collect it from your device and use it for the purposes described in this privacy policy. 

Information We Collect from You. Simplex Financials, Inc. collects information about you and your company from:

Account Information. When you sign up for a platform account or register as a user, we collect contact and identifying information about you and your business, your name; billing address; phone number; email; Tax Identification Number or Social Security Number (collectively, “TIN”); date of birth (natural persons); government-issued identification (natural persons); and Organization information, including company name and address, formation documents, business license, tax documents, phone number and business email address. We require you to choose a strong password, and may require you to provide device information to receive multi-factor authentication. We collect information from you when you use the Service, contact us for support, or provide us with feedback on the Service. As we introduce new products, services, or features, we may collect new and different types of information from you when you use the platform or contact Path By Simplex in connection with your account. 

US Patriot Act. To help the U.S. government fight the funding of terrorism and money laundering activities, federal and state law requires financial institutions, including services businesses like Simplex Financials, Inc., to obtain, verify, and record information that identifies every customer. What this means for you: When you use the platform, we will ask you for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents, such as business-related documents. We will let you know if additional information is required. 

Financial Information. When you use the Path platform, we collect certain financial information from you, such as access to all information from the accounting software. We may also collect information to verify financial condition of the business.

Information about your Customers and Vendors. We may collect information from you about your Customers and Vendors, including but not limited to name, address, email address, phone number, TIN, and financial information, based on your use of the platform. 

Feedback. We collect information that you choose to provide to us in connection with your feedback about your account, including through your use of the Path platform and your participation in the marketing of Simplex Financials, Inc. 

Internet Forms. We collect the information that you provide to us through internet forms, including but not limited to forms on our Website or social media forms, such as webinars sign-up forms or Facebook forms, LinkedIn forms etc. 

Marketing Participation. We collect the information that you provide voluntarily in connection with your participation in Path’s marketing, including but not limited to engagement at event booths, sweepstakes, contests, promotions, surveys, and referrals. Other When you use the platform or otherwise engage with Simplex Financials, Inc., even if you do not establish or use a Path account, we may collect information about you, such as name, company name, email address, phone, and mailing address. We may also collect information from you when you visit our Website. 

Sharing Your Data with Third Parties. As a general matter, customer determine their own policies for sharing and disclosing access to their data. Simplex Financials, Inc. does not control how customers, or their third parties choose to share or disclose customer data.

Aggregated and anonymized information shared for those purposes will contain personal and/or company information that can be associated with you.

Provided by Others Simplex Financials, Inc. may allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf on our online services and across the internet, and to track and report on the performance of those advertisements. These entities may use cookies, pixel tags, SDKs, and other technologies to identify your device when you use our online services and interact with our electronic communications and ads, as well as when you visit other online sites and services. Minors under the age of 18. Persons under the age of 18-year-old are not eligible to use, access or otherwise interest with the platforms or the Service. If Simplex Financials, Inc. becomes aware of a persons under the age of 18-years old using or accessing the Path platform or service, Simplex Financials, Inc. and/or 3rd Party affiliations will take the necessary steps to disable the account, and delete any information related to the minor as soon as reasonably possible. 

Changes to Privacy Policy. Any changes to this privacy notice may be updated as needed and will be on the websites owned by Simplex Financials, Inc. If there are any material changes to our privacy notice, we will post a notice on our website and/or provide other notice as required by law.
